The terms that apply when you buy Project 2 from us: pricing, payment, delivery, your right to cancel, returns and more.

Introduction

These terms apply when you preorder or buy from THE NEW WAVE through tnw.watch. Please read them before you place an order. By placing an order, you agree to them.

Online preorders are not open on this website yet. You can choose a watch and add it to your cart, but no order can be placed and no payment is taken until checkout opens. These terms describe how orders will work when it does.

THE NEW WAVE is a trading name. The seller is:

Definitions

“We”, “us”, “our”
THE NEW WAVE, the seller described above.
“You”
The person placing an order.
“Watch” or “product”
THE NEW WAVE Project 2, in the strap colour you choose.
“Order”
Your request to buy one or more watches through our checkout, including a preorder.
“Preorder”
An order placed for a watch that will be dispatched at a later date.
“Cart”
The selection of watches you are considering. Adding a watch to your cart does not place an order or hold a watch for you.

Our products

Project 2 is a mechanical watch with a full carbon-fibre octagonal case, sold in several strap colours. It is a limited edition of 500 pieces (1/500); orders are subject to availability.

We describe and photograph our products as accurately as we can. Images may differ slightly from the watch itself, for example because of screen settings, and some images are renders. Carbon fibre has a natural, variable pattern, so the pattern on your watch will be unique. The full specification is on our specifications page.

Prices, currency and taxes

  • The price of THE NEW WAVE Project 2 is $999 USD.
  • VAT and taxes are included in the displayed price where applicable. We do not add a separate tax charge on top of the price shown at checkout.
  • Prices are shown in USD. The final amount and currency are always shown at checkout before you pay, and that is the amount you will be charged. Your bank or card issuer may apply its own conversion or foreign transaction fees.
  • Shipping costs are shown at checkout before you pay.

  • If we make an obvious pricing error, we will contact you before dispatching and you may cancel for a full refund.

Orders and acceptance

  • You can order any number of watches in one order. There is no maximum per order.
  • Your order is placed when you complete checkout. We will confirm your order by email with an order reference.
  • We may decline or cancel an order, for example if the edition has sold out, if we cannot deliver to your address, or if we suspect fraud. If we do, we will tell you and refund any payment in full.

Preorders

  • A preorder is an order for a watch that will be dispatched later. When and how payment is taken for a preorder, and the expected dispatch timing, will be shown before you place it: [PREORDER PAYMENT AND DISPATCH TIMING TO BE CONFIRMED]
  • If dispatch will be later than we told you, we will let you know and you may cancel for a full refund of anything you have paid.
  • Your right to cancel (below) applies to preorders: you can cancel at any time after placing a preorder and before it is delivered, and for 14 days after delivery.

Payment

Payment is taken at checkout by our ecommerce platform and its payment provider: [ECOMMERCE PLATFORM AND PAYMENT PROVIDER TO BE CONFIRMED]. The payment methods available are shown at checkout. Your full card details are handled by the payment provider and are not stored by us.

Shipping and delivery

  • We ship worldwide, subject to applicable laws, sanctions and restrictions, carrier availability, destination restrictions and customs or import requirements. We cannot guarantee delivery to every destination. If we cannot deliver to your address, checkout will tell you before you pay.
  • Available shipping methods and their costs are shown at checkout.
  • Delivery times vary by destination. Estimated delivery information will be shown during checkout or in your order confirmation where available.
  • Please make sure your delivery address is correct. Contact us straight away if it needs changing.
  • The watch is your responsibility once it has been delivered to the address you gave us.

International orders

For deliveries outside the UK, your order may be subject to customs procedures in your country, which can affect delivery time. Consumer rights may also differ depending on where you live; where local law gives you additional rights, those rights apply.

Your right to cancel

If you are a consumer buying online, you have a legal right to change your mind. For UK consumers, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you 14 days to cancel, starting from the day after the watch comes into your physical possession (or that of someone you nominate), subject to the exceptions set out in those regulations. Consumers in other countries may have similar or additional rights under their local law.

How to cancel

  1. Tell us. Email hello@tnw.watch within the cancellation period with your name and order reference, stating that you wish to cancel. You may use the model cancellation form set out in the regulations, but you don’t have to.
  2. Return the watch. Send the watch back to us without undue delay and in any event within 14 days of the day you tell us you are cancelling. Returns procedure and address: [RETURNS PROCEDURE AND ADDRESS TO BE ADDED]
  3. Handle it with care. You may handle the watch only as you would in a shop, to establish its nature, characteristics and functioning. If it has been handled beyond that and has lost value as a result, we may reduce your refund by the amount of that loss, as the law allows.

Refunds

We will process refunds in accordance with applicable consumer protection law and the payment method you used. For UK consumers who cancel under the regulations above, we will refund the price you paid and the cost of standard delivery within 14 days of receiving the watch back, or of receiving evidence that you have sent it back, whichever is earlier.

Refunds are made to the original payment method, in the currency you paid, unless you agree otherwise. We will not charge you a fee for the refund.

Nothing in these terms removes or limits your statutory rights, including your rights if a watch is faulty, damaged or not as described.

Faulty or damaged watches

If your watch arrives damaged or develops a fault, please email hello@tnw.watch with your order reference and a description, including photos where possible. You have legal rights if goods are faulty or not as described; these are not affected by these terms or by any warranty we offer.

Warranty

Any warranty we offer is in addition to your statutory rights and does not replace, remove or limit them. If your watch is faulty, not as described or not of satisfactory quality, you have legal rights regardless of any warranty.

Intellectual property

The THE NEW WAVE and Project 2 names, logos, designs, images and website content belong to us or our licensors. You may view and share pages of this website for personal use, but you may not copy, reproduce or use them commercially without our written permission.

Using our website

Please use this website lawfully. Do not try to interfere with it, gain unauthorised access to it, or use it to place fraudulent orders. We may update or suspend parts of the website from time to time.

Our liability

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our failure, but not for loss that is not foreseeable. We supply products for private use only; if you buy for business purposes, we are not liable for loss of profit, business or opportunity.

We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for breach of your statutory consumer rights.

Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as carrier disruption, severe weather or supply problems. If this happens, we will contact you, try to limit the effect and, if there is a significant delay, you may cancel for a refund of anything you have paid for undelivered watches.

Changes to these terms

We may update these terms from time to time. The terms that apply to your order are the ones shown on this website when you placed it.

Governing law

If you are a consumer, the mandatory consumer protection laws of the country where you live continue to apply, and you may have the right to bring proceedings in your local courts.
