Privacy Policy
What we collect when you visit our website or buy a watch, why we collect it, who we share it with and the choices you have.
Who we are
This policy explains how THE NEW WAVE (“we”, “us”) uses personal information when you visit tnw.watch, buy a watch from us or contact us.
THE NEW WAVE is a trading name. The business responsible for your information (the “controller”) is:
- Legal name
- [LEGAL ENTITY NAME TO BE CONFIRMED]
- Registered address
- [REGISTERED ADDRESS TO BE CONFIRMED]
- Company number
- [COMPANY REGISTRATION NUMBER TO BE CONFIRMED]
- VAT number
- [VAT NUMBER TO BE CONFIRMED]
You can contact us about anything in this policy, or to exercise your rights, at hello@tnw.watch. We have not appointed a Data Protection Officer.
Information we collect
Your cart
When you add a watch to your cart, the watch, colour and quantity are kept on your own device (see our Cookie Policy) so your cart is still there as you move around the site. It is not sent to us, and it contains no personal information.
When you preorder or buy
Online preorders are not open on this website yet, and this website does not currently take orders or payments. When checkout opens, it will be provided by our ecommerce platform ([ECOMMERCE PLATFORM AND PAYMENT PROVIDER TO BE CONFIRMED]), and we will receive:
- Contact details: your email address, and your phone number if you choose to give it.
- Delivery details: your name and shipping address.
- Order details: the watch and strap colour you choose, quantity, amount paid, shipping method and an order reference.
- Payment details: card and wallet details are handled by the payment provider. We do not receive or store your full card number; we receive limited information such as whether a payment succeeded.
We will update this policy with the specific providers before checkout opens.
When you contact us
If you email us, we receive your email address and whatever you choose to include in your message.
Customer messages we quote
Our About page quotes messages customers have sent us on Instagram. We publish only the words of the message, cropped to the message itself: never your name, username or profile picture. If you would like a quote removed, email us and we will take it down.
When you browse the website
- Technical information: like any website, our server receives your IP address and basic request information (such as your browser type) in order to deliver pages to you. Our hosting provider ([HOSTING PROVIDER TO BE CONFIRMED]) may keep server logs as part of providing that service; retention of those logs: [TO BE CONFIRMED].
- Device storage: we use a small number of cookies and similar technologies, described in our Cookie Policy.
What we don’t do
We do not use analytics, advertising tracking or social media tracking pixels on this website, and we do not embed Instagram content. There are no customer accounts, and we do not send marketing emails. We do not sell your personal information. If any of this changes, we will update this policy and ask for your consent where the law requires it.
How we use your information
We use your information to:
- process your order and take payment;
- deliver your watch and keep you informed about your order;
- respond to your questions and provide customer support;
- handle returns, refunds and warranty claims;
- keep your cart on your device while you browse;
- prevent fraud and keep our website and checkout secure;
- remember your preferences on this device, if you allow it;
- share what customers have said about us, without their names (see above);
- keep the records we are required to keep, for example for tax and accounting.
Our legal reasons for using it
Under UK data protection law (the UK GDPR and the Data Protection Act 2018), we must have a lawful basis for each use of your information. We rely on:
- Contract
- Where we need the information to process your order, take payment, deliver your watch and deal with returns and warranty claims.
- Legal obligation
- Where we must keep or share information to comply with the law, for example tax and accounting records.
- Legitimate interests
- Where it is reasonably necessary to run and protect our business, for example preventing fraud, keeping the website secure and answering enquiries that are not about an order. We only do this where our interests are not outweighed by your rights.
- Consent
- For optional device storage that remembers your preferences. You can withdraw consent at any time using “Cookie settings” in the footer.
Who we share it with
We do not sell your personal information. We share it only with service providers who help us run the business, and only as much as they need:
- Ecommerce and payments
- [ECOMMERCE PLATFORM AND PAYMENT PROVIDER TO BE CONFIRMED]: when online preorders open, will process your order, payment and delivery details to provide checkout, payment and order management. Payment providers may also use information under their own privacy policies, for example to prevent fraud.
- Website hosting
- [HOSTING PROVIDER TO BE CONFIRMED]: hosts this website and processes the technical information needed to deliver pages.
- [EMAIL PROVIDER TO BE CONFIRMED]: handles email sent to and from hello@tnw.watch.
- Delivery
- [DELIVERY / FULFILMENT PROVIDER TO BE CONFIRMED]: receive your name, delivery address and contact details to deliver your order.
We may also share information where the law requires it, or to protect our rights, customers or others.
Our website links to our Instagram account, @thenewwave.watches. We don’t embed Instagram content, and nothing is shared with Instagram unless you follow the link, at which point Instagram’s own policies apply.
International transfers
We sell worldwide, and some of our service providers may process information outside the UK. When your order is delivered abroad, the carriers involved will also handle your delivery details in the countries the parcel passes through.
Safeguards for these transfers: [TO BE CONFIRMED AFTER AUDITING ACTUAL PROVIDERS].
How long we keep it
We keep personal information only for as long as we need it for the purposes above, including meeting legal, tax and accounting requirements.
- Orders and transaction records: [RETENTION PERIOD TO BE CONFIRMED].
- Customer and support emails: [RETENTION PERIOD TO BE CONFIRMED].
- Server logs kept by our hosting provider: [TO BE CONFIRMED].
- Your cart: on your device until you remove the items, empty your cart or clear your browser storage.
- Cookie choices: 6 months, or until you clear them.
Payment providers keep payment information under their own retention policies. When we no longer need information, we delete it or make it anonymous.
Security
We use appropriate technical and organisational measures to protect your information. Payment details will be handled by the payment provider, and our website is served over an encrypted connection. No method of transmission or storage is completely secure, but we work to protect your information and to limit who can access it.
Your rights
Depending on the circumstances and the law that applies to you, you may have the right to:
- access the personal information we hold about you;
- correct information that is inaccurate or incomplete;
- delete your information;
- restrict how we use it;
- object to our use of it where we rely on legitimate interests;
- receive information you gave us in a portable format;
- withdraw consent at any time where we rely on consent, without affecting what we did before.
Some rights are limited. For example, we may need to keep order records to meet our legal obligations. To make a request, email hello@tnw.watch. We may need to confirm your identity before responding, and we will reply within the time limits set by the law that applies (under UK law, normally one month).
If you are unhappy with how we have handled your information, please contact us first. You also have the right to complain to the UK Information Commissioner’s Office (ico.org.uk), or to the data protection authority where you live.
Changes to this policy
We may update this policy, for example if we add new services. The effective date at the top shows when it last changed. If we make significant changes, we will make that clear on the website.
